Welcome to Wishes! These Terms of Service govern your use of the Wishes mobile application operated by Wishes. By using our App, you agree to these Terms.
1. Acceptance of Terms
By downloading, installing, or using the Wishes App, you agree to be bound by these Terms and our Privacy Policy. If you do not agree to these Terms, do not use the App. You must be at least 13 years old to use this App.
2. Account Registration
To use certain features, you must create an account. You agree to provide accurate information, maintain account security, notify us of unauthorized access, and accept responsibility for all activities under your account.
3. App Services
Wishes provides card creation with templates, voice message recording, AI-powered message suggestions, card sharing via links and QR codes, RSVP management, personal card vault storage, social features, and gamification features.
4. User Content
You retain ownership of content you create. By using the App, you grant us a license to store and transmit your content to provide our services. You agree not to create content that is illegal, harmful, infringes rights, contains hate speech, is explicit, or violates privacy.
5. AI-Generated Content
AI-generated content is provided as-is. You are responsible for reviewing AI suggestions. AI content may not always be accurate. AI features are subject to third-party service availability.
6. Subscriptions and Payments
Some features require a paid subscription. Subscriptions are billed through Apple App Store or Google Play and automatically renew unless cancelled. Refund requests are handled by Apple or Google according to their policies.
7. Intellectual Property
The App, including its design, features, templates, and code, is owned by Wishes and protected by intellectual property laws. Templates are licensed for personal, non-commercial use within the App only.
8. Prohibited Conduct
You agree not to violate laws, interfere with the App, attempt unauthorized access, use automated systems, collect user information without consent, send spam, or circumvent security measures.
9. Privacy
Your privacy is important to us. Our Privacy Policy explains how we collect, use, and protect your information. By using the App, you consent to our data practices.
10. Third-Party Services
The App integrates with authentication providers, database and media storage providers, AI services, notification providers, payment processors, and crash or analytics services. Your use of these services is subject to their respective terms.
11. Disclaimer of Warranties
THE APP IS PROVIDED AS-IS WITHOUT WARRANTIES OF ANY KIND. WE DO NOT WARRANT THAT THE APP WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS. YOU USE THE APP AT YOUR OWN RISK.
12. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WISHES SHALL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES. Our total liability shall not exceed the amount you paid us in the past 12 months, or $100, whichever is greater.
13. Indemnification
You agree to indemnify Wishes from any claims arising from your use of the App, your content, or your violation of these Terms or rights of others.
14. Account Termination
You may delete your account at any time through App settings. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use the App ceases immediately.
15. Changes to Terms
We may modify these Terms at any time. We will notify you of material changes. Your continued use after changes constitutes acceptance of the new Terms.
16. Governing Law
These Terms are governed by applicable laws. Any disputes shall be resolved in the appropriate courts.
